Hello all. I had filled form 10iea last ay to opt out of new regime as had lots of deductions last ay. This year also I have multiple deductions under old regime but by mistake or confusion u can say I filled form 10iea once again this ay and due to this now I can’t e-verify my returns as on the last validation it is asking details of both year form 10 iea. To fill this year’s form 10iea details I need to file in new regime which is not appropriate for me as I can’t claim deductions available in old regime. @Quicko and other tax experts request your help on this. My intention is to stay in old regime only this ay.

Go to e- File menu > Income Tax Forms > File Income Tax Forms.
You should be able to file this year’s form 10IEA and later use it to file your return
Thanks but as i mentioned above I have filled and verified form 10 iea (albeit by mistake or confusion) and due to this when I try to e-verify my itr it blocks me on final validation stating that I have not filled details of this ay form 10iea in filing status section. To fill this ay form 10 iea details I need to opt out of old regime which I don’t want to.
@Meher_Smaran … can this be resolved by verification through ITR-V physical copy sent to cpc… do anyone still use this method for verification of returns?
if it is ITR-3, afaik, it is once to opt-out and once to re-enter new regime.
only for people with non-business income can opt so if you are with itr-3, as per the info on their website, you are locked to the new regime. ( until you go back to ITR1 or 2)
First clarify which ITR form you will use to file returns.
I fill ITR 3
then it is not reversible for current AY or subsequent AY as long as it is ITR-3.
What surprises me is that in ITR-3 and Form 10-IEA, it is clearly mentioned.
In ITR-3, it asks for last AY date and Acknowledgement/application number to be used to continue to stay in old regime.
just evaluate the differences b/w old and new. This year, only some scenarios in old scheme are better than new.
But next FY, most scenarios of new regime are far better.
Maybe only this year you may be at some disadvantage.
Do you have salary income, or a quite large “actual” HRA deduction?
Yes I have lots of deductions to claim which are allowed in old regime but disallowed in new eg. HRA, 80c, 80ccd1b 80d etc
@VIPULK You need to file your tax return under new tax regime if you have filed form 10IEA and re-entered the new tax regime as mentioned in the form for this year.
You can continue with old tax regime in case you file ITR 1 or 2.

Thanks @Quicko but this results in tax liability for me. In case I file the itr under old regime and do verification through ITR-V as a last resort along with a note that form 10iea was filled by mistake for ay 2025-26, do u think they will accept.
Consult a CA & pay the fees.
seeking random or speculative advice will invite trouble.
The AO / system can flag you for n number of reasons.
opt-in / opt-out for ITR-3 is not flip-flop, it is committing for subsequent years.
A proper CA can later represent your case.
@VIPULK In our opinion, they will not. You can still call Income tax support team and confirm the same.

I did the same thing. Its not confusing, the way questions are framed, it forced us to file 10 IEA for this AY.
Its very misguiding.

I had raised the grievance in Income Tax portal to which I got this reply i.e. now it has to be filed in new regime only. How draconian

Stupid people. While filing 10IEA, nowhere in the process, they said that we are “Re-entering " New Tax regime” !
But, at the end of submission, they were able to pickup that 10IEA filing for FY 24_25! Its utter stupid. Someone without good knowledge of English might have constructed that module.
There are clear cut questions in ITR-3 itself.
If you read those first, it would be clear what they required.
Incase you want to continue with old-regime opted last AY, then you need to provide those old details.
Specifically to Form 10-IEA, this is what it showed incase some tried to fill it again.
Opt-out is disabled, only option is to re-enter.
I’m not defending them, but it was very obvious to me so i find it hard how someone filed the form again.
in Form 10-IEA, there are multiple sections, and then verify and validate with otp. Its not as easy as accidentally clicking.
Anyway, from a larger overview, FY2025-2026 New Regime saves more tax in most scenarios.
It is only in this AY you may lose out in some scenarios.
With relative having all 80C, 80D, HRA, NPS etc also the new regime saved a bit more tax, so ended up using new regime.
@VIPULK do let me know if you found the resolution to this. Even I have done the same it’s very confusing
