Gift deed for gifting shares and stamp duty amount

I wish to gift some shares to my parents. I know how to transfer the shares using CDSL easiest and if they sell them, it would be taxable with my original buy price itself.

My question is regarding the gift deed and stamp duty required. Could someone form Zerodha or @Quicko help us with the template of the gift deed and also tell us the amount of stamp duty to be used. Thanks!

Follow carefully. There are 2-3 different passwords and things involved. it was a headache for me.

Stamp duty not applicable on gifting of shares since you are not receiving any money.

If the off-market transfer is not a gift or self-transfer and involves a consideration, stamp duty (PDF) must be paid to CDSL online (PDF) before making the transfer.

To clarify I was asking for the stamp duty to be used when notarising the gift deed :slight_smile:

Is there a reason for using a deed? CDSL’s transfer record is enough legal proof right?

Especially since it is within the family and not taxable.

Like you are transferring electronically and there is a clear trail. Gift deed seems unnecessary in my opinion.

However, executing a gift deed will help create a legal record evidencing the transfer.

For the gift deed, you’ll have to get in touch with a legal person. The stamp duty charges also vary from state to state.
