There won’t be any penalty, it is applicable only for not maintaining non-upfront margins. The scenario you have given falls under upfront margin penalty, which is applicable on brokers. Explained in detail here: What is a margin penalty, and why is it charged?
You will get margin benefit like you normally done once all the legs are executed.
